Terms of Service

We host and stream browser games and process payments between players and creators. June 17 is a venue: creators are independent operators who set their own prices and decide what to publish, and are not employees, partners, or agents of June 17. We may modify, suspend or discontinue any part of the Service at any time, with or without notice.

You must be at least 13 years old, or the age of digital consent in your country if that is higher (16 in some EEA countries). You must provide accurate information and verify your email address. Keep your credentials secure and do not share them — you are responsible for all activity under your account.

If you are under 18, you may use the Service only with the involvement of a parent or guardian, and only they may agree to these Terms on your behalf where you cannot do so yourself.

We ask for your date of birth when you sign up and use it to enforce the age rating each creator declares for their game: if you don’t meet a game’s required age, you can’t buy or play it. Because it controls that gate, your date of birth can only be set once — contact us if it needs correcting. Providing a false date of birth is a breach of these Terms.

Creators keep 85% of the sale price of their games; June 17 retains a 15% platform fee. Payouts are made through Stripe Connect, on a short rolling delay after each sale, and are subject to Stripe’s terms. Creators are responsible for the content, ratings, and legality of what they publish, and for any applicable taxes on their earnings.

Buying a game grants you a personal, non-transferable licence to play it on June 17. You are responsible for any applicable taxes.

If you are under 18, you may make a purchase only with the permission and involvement of a parent or guardian, and you confirm you are authorised to use the payment method you provide.

If you bought a game within the last 3 days and haven’t meaningfully played it (roughly two minutes or less), you can get an automatic refund from Request a refund. Outside that window, or once you’ve played further, you can still send a request and we’ll review it individually. A refund reverses the charge and removes your access to the game. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service. You may not:

• copy, modify, reverse engineer, decompile, or attempt to extract the source code of the Service or of any game hosted on it;
• circumvent, disable or interfere with security, licensing, rate-limiting or content-protection mechanisms, including the encrypted bundles and streamed runtime that deliver games;
• pirate, extract, rip, or redistribute games hosted on the Service;
• upload content you don’t have the rights to, or misrepresent a game’s content rating;
• use the Service for any unlawful, harassing, abusive, or fraudulent purpose;
• falsify records, or attempt to circumvent purchases, refunds, payouts, or other platform controls;
• impersonate any person, or misrepresent your identity or affiliation;
• share another user’s private information without consent, or harass, threaten, or intimidate other users;
• resell, sublicense or redistribute the Service, use it to build a competing product, or use automated means to scrape or overload it; or
• use the Service in violation of export-control laws or trade sanctions, or of any applicable law or third-party right.

We may restrict, throttle or suspend access where we detect abuse, excessive usage, or behaviour that threatens the stability of the Service or other users.

You retain ownership of what you submit — the games you publish and the reviews and posts you write (“Your Content”). You grant us a limited, worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, cache, transmit and display Your Content as necessary to operate the Service — including streaming your game to players who own it. You represent that you have the rights to Your Content and that it does not infringe any third party’s rights or violate any law.

Feedback. If you send us feedback, suggestions or ideas, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use and incorporate them without restriction or compensation.

We may screen, review, and remove content, and suspend or ban accounts, when content or conduct breaks these Terms. Games are reviewed before publication, but review is not an endorsement or a guarantee. Please report violations with the in-product reporting tools.

The Service — including the June 17 software, player runtime, editor, designs, logos and brand — is owned by Bitsmart Global LLC and its licensors and is protected by intellectual-property laws. These Terms grant you no rights in our intellectual property except the limited licence above. Games remain the property of their creators.

The Service relies on third parties, including Stripe for payments and payouts and our cloud hosting and storage providers. Their availability and handling of data are governed by their own terms, and we are not responsible for third-party failures.

By using the Service you may receive transactional and service messages — purchase receipts, refund updates, review and payout notifications — by email and, where you enable it, by push or in-app notification. You can manage or turn these off in your settings, though certain essential account, security, or transaction messages may still be sent.

You may request deletion of your account at any time from your settings. Your account then enters a 30-day grace period: it’s deactivated and hidden, but not yet erased, and signing back in within those 30 days restores it. After 30 days it is permanently deleted and cannot be recovered.

We may suspend or terminate your access at any time, with or without notice, for any breach of these Terms or conduct we consider harmful to other users or the Service. On termination your licence to use the Service ends; sections that by their nature should survive — ownership, disclaimers, limitation of liability, indemnification and the feedback licence — will survive.

The Service is provided “as is” and “as available”, on a best-effort basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that game saves or other data will never be lost or corrupted. We do not guarantee any minimum uptime, availability or performance level, and we do not endorse or guarantee any creator or game.

While we use reasonable measures to protect the Service, we do not guarantee it will be free from unauthorised access, security breaches or cyberattacks. Nothing in these Terms excludes any liability that cannot be excluded under applicable law.

To the maximum extent permitted by law, Bitsmart Global LLC and its owners, developers and affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities. Our total liability for any claim relating to the Service will not exceed the greater of (a) the total amount you paid us for the Service in the twelve (12) months preceding the claim, or (b) USD 100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Game progress is saved to your account as a convenience, not as a backup service. You are responsible for maintaining your own copies of anything you create as a creator, and we are not liable for loss of saves, data or outputs.

You agree to indemnify and hold harmless Bitsmart Global LLC and its owners, officers, employees, agents and affiliates from any claims, liabilities, damages, losses and reasonable expenses (including legal fees) arising from Your Content, your use of the Service, or your violation of these Terms, any law, or the rights of another.

Please contact us first — most concerns are resolved informally at hello@june17.app. These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules, and you agree to the exclusive jurisdiction of its courts, except where applicable law gives you the right to your local courts. To the extent permitted by applicable law, you agree to resolve disputes with us on an individual basis and waive any right to participate in a class action.

We may assign or transfer these Terms, in whole or in part, including in connection with a merger, acquisition or sale of assets. You may not assign these Terms without our prior written consent. If any provision is held unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to enforce it later.

Your use of the Service is also governed by our Privacy Policy. We collect the account and usage information needed to run the store, and we do not sell your personal information.

We may update these Terms from time to time. If we make material changes we will update the “Last updated” date and, where appropriate, notify you. Continued use of the Service after changes take effect means you accept the updated Terms.
